Terms of sale

These terms of sale ("Terms") govern every purchase made by consumers on etoilediamonds.com (the "Shop"). Please read them before ordering. By placing an order you confirm that you have read and accept them.
1. Who we are
The Shop is operated by Etoile Diamonds OOD, a limited liability company registered in the Commercial Register of the Republic of Bulgaria under UIC (EIK) 206030970, VAT number BG206030970, with its registered office at [registered street address], Sofia, Bulgaria ("Etoile", "we", "us").

2. Who can buy
2.1. The Shop sells to consumers, meaning natural persons acting for purposes outside their trade, business, craft or profession. Business buyers are served through our trade portal at b2b.etoilediamonds.com under separate terms.
2.2. You must be at least 18 years old and able to enter into binding contracts.
2.3. We deliver only to addresses in the member states of the European Union.
3. Products
3.1. Made to order. Most pieces are made for you once you order, in the design, shape, metal, stone, grade, carat weight and ring size you choose. Product images on the Shop may be illustrations or photographs of a similar configuration. Natural variations in stones and hand finishing mean each piece can differ slightly from its image.
3.2. Ready to ship. Pieces marked "Ready to ship" are finished items held in stock, in the stated size and specification.
3.3. Stones. We describe each stone as what it is: lab-grown diamond, natural diamond or moissanite. Lab-grown diamonds of 0.70 ct and above come with a grading report from IGI; natural diamonds with a grading report from GIA; moissanite with a certificate of authenticity. Grades and measurements are those stated by the grading laboratory, within its stated tolerances.
3.4. Metals. Gold is offered in 14K (585) and 18K (750) fineness, and platinum in 950 fineness. Metal weights shown are approximate.
3.5. Personalisation. Engraving (up to 20 characters) and paid extras chosen on the product page form part of the specification of your piece.
4. Prices
4.1. Prices are shown in euros (EUR) and include VAT at the applicable rate. Delivery within the EU is free of charge.
4.2. Any price reduction is shown against the lowest price we applied in the 30 days before the reduction, in accordance with Article 6a of Directive 98/6/EC as transposed into Bulgarian law.
4.3. If a price is shown in obvious error (for example, a price manifestly far below the item's value), we will contact you before accepting your order and you may confirm the correct price or cancel at no cost.
5. How the contract is formed
5.1. The product pages are an invitation to make an offer. You make an offer to buy by completing checkout and clicking the button that commits you to pay.
5.2. Before you pay, the checkout shows the pieces, their specification and the total price including VAT and delivery. You can correct your entries at any time before confirming payment.
5.3. The contract is concluded when we confirm by email that your payment has been received ("Order confirmation"). The order confirmation, these Terms and the information on the product page form the contract. We keep a copy of your order; you can view it at any time through the link in the order confirmation or in your account.
5.4. The contract is concluded in the language of the Shop version you used: English, Bulgarian, German, French or Italian.
6. Payment
6.1. Payment is made at checkout through our payment service provider, Stripe Payments Europe, Ltd., by the methods offered there (for example card, Apple Pay, Google Pay or local methods). We do not receive or store your card details.
6.2. If a payment method settles after a delay (such as a bank debit), we begin making your piece once the payment has cleared.
6.3. Discount codes apply only as stated, cannot be exchanged for cash and only one code can be used per order.
7. Making and delivery
7.1. Estimated times. Made-to-order pieces are usually dispatched within three to four weeks of the order confirmation; ready-to-ship pieces within two working days. The product page shows an estimated delivery date for your order. If we cannot meet it, we will tell you and give you a new date; you may then cancel and receive a full refund.
7.2. Delivery is made by an insured and tracked courier to the address given at checkout, against signature. We email you a tracking link at dispatch.
7.3. Risk of loss or damage passes to you when you, or a person you name other than the carrier, take physical possession of the parcel.
7.4. Please inspect the parcel's seal on delivery and note any visible damage to the packaging with the courier.
8. Your right of withdrawal
8.1. You have a statutory right to withdraw from the contract within 14 days without giving any reason. We extend this period to 30 days from the day you, or a person you name other than the carrier, take physical possession of the goods.
8.2. Exception. Under Article 57(3) of the Bulgarian Consumer Protection Act and Article 16(c) of Directive 2011/83/EU, the right of withdrawal does not apply to goods made to your specifications or clearly personalised. This covers engraved pieces and pieces made to a custom design you commissioned. Pieces assembled from the options offered on the product page without engraving remain covered by the right of withdrawal under these Terms.
8.3. The full withdrawal procedure and the model withdrawal form are set out in Right of withdrawal, which forms part of these Terms.
9. Legal guarantee of conformity
9.1. We are liable for any lack of conformity of the goods that exists at the time of delivery and becomes apparent within two years of delivery, in accordance with the Bulgarian Act on the Supply of Digital Content and Digital Services and the Sale of Goods (transposing Directive (EU) 2019/771).
9.2. In the event of a lack of conformity you are entitled to have the piece brought into conformity by repair or replacement free of charge, or, where the law provides, to a proportionate price reduction or termination of the contract.
9.3. Please tell us about any lack of conformity as soon as you notice it at hello@etoilediamonds.com.
10. Commercial warranty
In addition to, and without affecting, your statutory rights, we give a lifetime warranty against manufacturing defects as described on the warranty page. We also offer one free resize within the first year after delivery, as described in the help centre.
11. Liability
11.1. We are liable without limitation for death or personal injury caused by our negligence, for fraud, and for any liability that cannot be limited under applicable law.
11.2. Otherwise our liability for any order is limited to the price paid for that order. We are not liable for losses that were not foreseeable when the contract was concluded.
12. Account
12.1. You can order as a guest or with an account. Keep your password confidential; tell us promptly if you believe your account has been used without your permission.
12.2. We may suspend an account that is used fraudulently or in breach of these Terms.
13. Complaints and dispute resolution
13.1. Please send complaints to hello@etoilediamonds.com. We reply within 7 working days and aim to resolve every complaint within 30 days, as required by the Consumer Protection Act.
13.2. If we cannot resolve a dispute, you may refer it to an alternative dispute resolution body. The competent bodies in Bulgaria are the General Conciliation Commission and the sectoral conciliation commissions at the Commission for Consumer Protection, 1000 Sofia, 4A Slaveykov Square, www.kzp.bg. Consumers resident in another member state can obtain help from their national European Consumer Centre (ECC-Net).
13.3. Nothing in these Terms limits your right to bring proceedings before the competent courts.
14. Governing law
14.1. These Terms are governed by the laws of the Republic of Bulgaria. If you are a consumer resident in another EU member state, you also keep the protection of the mandatory provisions of the law of your country of residence.
14.2. The UN Convention on Contracts for the International Sale of Goods does not apply.
15. Changes to these Terms
We may update these Terms for future orders. The version that applies to your order is the one shown on the Shop when you placed it; we keep a record of it.
